How to end a lease by certified letter, and when to mail it

Read the notice clause in your lease first: it usually says how many days of notice you owe, whether the notice must be in writing, where it goes, and sometimes how it must be sent. Then write a short letter naming the property, the lease, and the date the tenancy ends, and send it so it arrives inside the notice period. Start with the notice clause

Most written leases have a paragraph headed “Notices” and another on termination or renewal. Between them they usually answer four questions, and your letter has to satisfy all four:

  1. How much notice. Thirty or sixty days is common for a month-to-month tenancy; a fixed-term lease may need notice before the end of the term to stop it renewing automatically.
  2. From when. Some leases count from the day notice is given, some from the day it is received, and some require the tenancy to end on the last day of a rental period.
  3. To where. The notice address in the lease, which for a managed building is often the management company’s office, not the leasing desk or the property itself.
  4. How. Some leases say “in writing” and nothing more; others say “by certified mail, return receipt requested” or list personal delivery. If the clause names the paper green card specifically, buy it at a Post Office counter; Piloxa sends the electronic return receipt, not the card.

Where the lease is silent, state law fills the gap. In California, Civil Code 1946 has a tenant give 30 days’ notice to end a month-to-month tenancy, and Civil Code 1946.1 has a landlord give 30 days if the tenant has been there under a year and 60 days if a year or more. Just-cause rules under Civil Code 1946.2, and local rent ordinances, can limit a landlord’s right to end the tenancy at all. California’s statutes for these notices also list certified or registered mail among the permitted methods; other states differ, so check yours.

Count backwards from the last day

The mistake that costs people an extra month of rent is mailing on the day the notice period starts. If the period runs from receipt, a letter mailed that day arrives too late. Work from the end:

If your lease counts from the mailing date instead, the postal record of when the letter was handed over is the date that matters, and the margin can be smaller. Earlier is never wrong: a notice that arrives two weeks early still ends the tenancy on the date it names.

A landlord ending a tenancy uses the same structure but must check the required contents for that state: in California, for example, just-cause tenancies need the reason stated, and some notices must include specific statutory wording.

When certified mail is enough, and when it is not

For a tenant giving notice, certified mail is usually enough, and it is often exactly what the lease asks for. For a landlord, it depends on the notice: an ordinary non-renewal or 30/60-day notice can often go by mail, but a notice that is the first step of an eviction usually has its own service rules (see notices to vacate). And certified mail proves that a letter was mailed and delivered, not what was inside it. When the deadline is tight: the Deadline Notice

A landlord who does not want you to leave, or a tenant who has stopped answering, can simply not collect a certified letter. It then sits at the Post Office and comes back after 15 days, which can be after your notice date. Questions people ask

Do I have to send a lease termination letter by certified mail?

Only if your lease or state law says so. Many leases only require written notice. Certified mail is still the safer choice, because it gives you a mailing date and a delivery record if the landlord later says no notice arrived.

Does the 30 days start when I mail it or when they receive it?

It depends on the lease and the state. Some count from the day notice is given or mailed, some from receipt. When in doubt, count from the day it is likely to be received and mail a week or more before that.

What if my landlord refuses the letter?

The refusal is recorded by USPS and the letter comes back to you. Keep the returned envelope unopened. Many leases and statutes treat a properly addressed notice as given; a second copy by ordinary mail or email helps show you tried every channel.

Can I end a fixed-term lease early with a letter?

A letter can tell the landlord you are leaving, but it does not by itself release you from rent owed for the rest of the term. Look for an early-termination clause in the lease and any state rules that let a tenant end a lease early in specific situations.

Where do I send it?

To the notice address in your lease, in the landlord’s or company’s legal name. If the lease names no address, use the address where you pay rent or the owner’s address of record.
