Certified Mail unclaimed: how long USPS holds it, and what to do next
When nobody is available to sign, the carrier leaves a notice (PS Form 3849) and the letter waits at the Post Office. If the recipient does not collect it or ask for redelivery, USPS returns it to the sender after 15 days, or after fewer days if the sender specified fewer on the piece (DMM 508.1.1.7). Counting the trip out and back, an unclaimed letter usually reaches the sender three weeks or more after it was mailed. Do not count on a second notice arriving on a set day; plan around the 15-day figure.
What unclaimed means for your notice
Unclaimed is weaker evidence than refused. A refusal shows the person had the letter in front of them and turned it away. Unclaimed shows only that a notice was left and nobody came, which can be explained by a vacation, a hospital stay or a notice that blew away.
How the law treats it varies. Some notice rules count from mailing, so an unclaimed letter can still be timely notice; under the federal rules, for example, serving a later paper by mail to the last known address is complete upon mailing (FRCP 5(b)(2)(C)). Some courts find that deliberately ignoring a certified-mail notice does not defeat notice. Others require actual receipt, and an unclaimed letter does not show it. A contract’s notice clause may decide the question for you, so read it. The returned envelope and the tracking history are the evidence either way.
What to do next
- Keep the returned envelope sealed. Leave it unopened, with its label and markings. Photograph both sides.
- Save the tracking history showing the notice, the hold and the return, with dates.
- Check the address. Run it through the recipient address check. If the recipient uses a PO Box, collection depends on them checking it (PO Box delivery).
- Check your deadline. If your notice counts on mailing, the clock may already be running. If it requires receipt, send again now.
- Send it again, two ways. Certified Mail again, plus a plain First-Class copy that goes into the mailbox without anyone having to sign or go to the Post Office.
