What a demand to a former tenant should include

  1. The tenancy. The address, the lease date and the date the tenancy ended or the tenant left.
  2. A ledger, not a total. Each month of unpaid rent, any other charges the lease allows, and any payments received. Attach it.
  3. The deposit. What you held, what you deducted and why. Most states require an itemized statement within a deadline after move-out (21 days in California under Civil Code 1950.5); the demand should agree with it, and should show the deposit already credited.
  4. The amount demanded and how to pay. One figure, and the address or account where payment goes.
  5. A calendar date. Ten to fourteen days is common.
  6. What happens next. A small claims filing, or a referral to a collection agency. Say only what you will do. A collection agency or attorney collecting for you is bound by federal debt collection rules that do not apply to your own letter, so keep your letter factual and free of threats you cannot carry out.

When certified mail is enough, and when it is not

For a former tenant, certified mail is not just enough, it is the standard. Small-claims forms commonly ask whether you demanded payment before filing, and a dated delivery record answers that. If the tenant refuses or never collects the letter, USPS records that too and returns it after 15 days; keep the envelope unopened, and consider sending a copy by ordinary mail or email as well. For the current-tenant pay-or-quit notice, certified mail is a supplement to the statutory method, never a replacement for it, unless your statute names it.

Should a rent demand letter be sent certified?

To a former tenant, yes: it gives you a dated record that you asked for payment before going to court. To a current tenant, the demand is usually a statutory pay-or-quit notice that has to be served by the method your state lists; a certified copy is an extra record on top.

Can I include late fees in the demand?

In a demand to a former tenant you can claim what the lease allows, itemized separately. In a pay-or-quit notice, some states allow only rent in the amount demanded, and an overstated figure can invalidate the notice. Check your state’s rule.

How long should I give them to pay?

For a former tenant, ten to fourteen days is common and reasonable. A pay-or-quit notice period is fixed by statute, commonly a few days to two weeks, depending on the state.

What if I only have the old address?
