Your servicer is allowed to name one address, and only that one counts
This is the cleanest example in American consumer law of an address that is fixed by rule. Regulation X lets a mortgage servicer designate a single address for notices of error and requests for information. Where a servicer has done that, a letter to any other address of theirs is not a notice of error at all: no acknowledgement is owed, no answer is owed, and the protections that follow never start. People lose months this way writing to the payment address.

The rule, in one paragraph
12 CFR § 1024.35 sets out the error resolution procedure for mortgage servicing, and it allows a servicer, by written notice to the borrower, to establish an address that a borrower must use to submit a notice of error. The parallel provision for requests for information is § 1024.36, and where a servicer designates an address it is the same one for both.
So the first question is not what to write. It is whether your servicer has designated an address, and what it is.
Where that address is printed
- Your monthly mortgage statement. Look for a heading that names notices of error, qualified written requests, or written requests for information. It is rarely the payment address and rarely the general correspondence address.
- The servicer’s website, usually on a contact or help page, under the same headings.
- The transfer notice you received when the loan moved to this servicer.
- The annual escrow statement or the welcome pack from the servicer.
If you genuinely cannot find a designated address anywhere in your documents, the notice goes to the servicer’s ordinary address for correspondence. Keep evidence that you looked, and where.

What the servicer owes you once it lands
Regulation X puts short, counted deadlines on the servicer: an acknowledgement within five business days of receiving the notice, and an answer within thirty business days for most asserted errors, with a shorter clock where the request is for a payoff figure. The exact counting rules are in § 1024.35(d) and (e).
Every one of those counts runs from receipt. That is why the letter goes certified: the date on your side is otherwise the date you say you posted it.
What counts as an error worth this letter
Name the error, the account number, the property address, and the dates. Enclose copies of the proof. Keep it to the error: a letter that also complains about the hold music gets answered as a complaint rather than as a notice of error.
Why certified, on this letter above all
Two reasons. The deadlines run from receipt, so receipt has to be provable. And a notice of error is often the last step before something serious — a complaint to the Consumer Financial Protection Bureau, a claim, or a foreclosure defence — where the file has to show what was sent, to the designated address, on a date a third party recorded. What you end up holding
You are buying USPS Certified Mail, so the Postal Service keeps its own delivery record. Common questions
Where do I mail a notice of error to my mortgage servicer?
To the address your servicer has designated for notices of error, if it has designated one. 12 CFR 1024.35 lets a servicer establish a single address that a borrower must use, and a notice sent to any other address of theirs does not count. The designated address is printed on your monthly statement and on the servicer’s contact page.
Can I just send it to the payment address?
No. The payment address is a lockbox for cheques. Where a servicer has designated an address for notices of error, that is the only one that starts the clock.
What if my servicer has not designated an address?
Then the notice goes to the address the servicer uses for correspondence about the loan. Keep a note of where you looked, because the servicer will be asked whether it had designated one.
Is a notice of error the same as a qualified written request?
They overlap. “Qualified written request” is the older term from the Real Estate Settlement Procedures Act; the current rules split it into notices of error under 12 CFR 1024.35 and requests for information under 12 CFR 1024.36. Servicers usually give the same address for both.
